In the Irkutsk region, the court made a decision to pay the plaintiff compensation for moral damage.  The reason was the inflicted physical and moral suffering, which the plaintiff received as a result of interaction with an object of increased danger - a train.

The Russian Railways were declared the defendant in the case. The demand arose after a woman, being near the railway tracks and being drunk, approached them and laid her head on the rails.

The driver of the approaching freight train tried to prevent a collision, but still failed to avoid injury.

The plaintiff required qualified medical assistance, after which a trial arose.

Substantiating her claims, the woman indicated that as a result of the incident she received both physical and moral suffering, and therefore needed compensation. Russian Railways, in turn, did not recognize the claim, indicating that the victim independently stepped onto the track and laid her head on the rails, thereby allowing gross negligence on her part, IRK.ru reports.

However, the court nevertheless recovered non-pecuniary damage, indicating that Russian Railways is the owner of the source of increased danger, which imposes obligations on the defendant to compensate for the damage caused even in the absence of guilt.
