On April 19, the Leninsky District Court of Voronezh put the bankruptcy trustee Igor Vyshegorodtsev on the wanted list. Judge Marina Galagan has changed the measure of restraint of a man previously released on bail to the arrest, as she has not found him in the courtroom. Now, if the “lost” Vyshegorodtsev is found, he can be placed in Voronezh Detention Center No. 1 for several months.
A well-known specialist who heads the local branch of the “Avangard” SRO is accused of embezzlement under Part 4 of Article 160 of the Criminal Code of the Russian Federation. The criminal case has been dragging on since the end of 2017. Initially, the investigation assumed a more serious charge of fraud (under part 4 of article 159 of the Criminal Code of the Russian Federation) with a possible punishment of up to 10 years in prison.
If Vyshegorodtsev's guilt is proven and he himself is caught, the court may sentence him to two years of restraint of liberty. While the search for the accused is ongoing, the court suspended the proceedings.
The case itself is built around the bankruptcy of the state enterprise “Voentorg No. 769”.
At the stage of a bankruptcy management, when Vyshegorodtsev dealt with the insolvency of the organization, its assets were replaced (they, in particular, included a canteen and a store). They ended up in the authorized capital of the “Vera” company (OJSC). Then, as part of a full stake in the company, the assets were sold to another legal entity (Laksa-pro LLC). The deal for 5.8 million rubles was completed.
Investigators believe that legally, the bankruptcy trustee could not dispose of the assets of a state-owned organization. The very property of "Voentorg" did not belong to the organization, but was under its economic jurisdiction. At the same time, according to the accusing party, the interests of the state were damaged in the amount of 68 million rubles.
Vyshegorodtsev previously reported that the accusation was far-fetched, and he himself was innocent.
The lawyer pointed out that the basis of his actions was the law, which terminates the ability of the state authorities to dispose of property after the stage of bankruptcy proceedings has begun.
Despite this, he repeatedly expressed fears that he would be sentenced to punishment by the court. The reason for this, according to the accused, may be the revenge of the law enforcement system to him personally, since he publicly challenged its decisions many times and drew attention to its mistakes.
