A ruling on the claim of Mercedes-Benz RUS JSC was issued by the Kuban Arbitration Court on November 16. In the claim, the company demands to declare the ‘Committee for the protection of the rights of consumers and entrepreneurs of the Krasnodar Territory’ insolvent. Judge Alexander Pozdnyakov, who issued the ruling, set the next hearing in the case (No. À32-52763 / 2021) for 17 January.  The declared amount of claims is 3,745,240 rubles.

The Committee has existed in Krasnodar since 2012.  The founders of the public organization were Alexander Berezhnoy and several other persons. The organization has been actively involved in various litigations, representing the interests of consumers and entrepreneurs.
However, on November 16, it was liquidated by a court decision on the basis of Art.  29 of the Federal Law No. 82-FZ.
Aleksandr Berezhnoy, the head of the Committee, was a member of several other public organizations in Kuban that had similar names.  What exactly the claims of Mercedes-Benz to liquidated Krasnodar public figures are connected with is unknown.  But as suggested by RBC, the claim from the auto concern may be associated with the consequences of the scandalous story, which was reported several years ago.

In 2019, automakers representing well-known world brands filed complaints with various Russian authorities, indicating that a corruption scheme is being implemented in the district courts of the capital of Kuban, which allowed them to recover from the auto concerns the costs of cars that were much higher than the prices at which the cars were purchased by consumers.  The appeals were addressed to the Prosecutor General, the Higher Qualification Panel of Judges and the FSS.

Considering that in the majority of cases that the media wrote about that time, the very Committee under the leadership of Alexander Berezhny appeared, the organization filed lawsuits against several media outlets (RBC and Yugopolis) to protect its reputation.  In the materials of the case (No.A32-28679 / 2019), material compensation for damage was declared in the amount of 3.45 million rubles from each of them.
By August 2019, the case against the media collapsed, as the judge issued a ruling to leave the application without consideration.
One of the formal reasons was the violation of the claims procedure.  After that, many chose to forget about the disputes between the Committee for the protection of the rights of consumers and entrepreneurs of the Krasnodar Territory and the media representatives, who cited the appeal of the auto concerns.  However, now, after the organization itself has been liquidated, and a bankruptcy claim has been filed against it, there is a reason to recall the scandal that took place two years ago.
