Savelovsky Court of Moscow is about to consider a class action lawsuit filed by clients of the GeekBrains educational platform.  The plaintiffs expressed dissatisfaction with the terms of the offer, according to which it becomes difficult for the consumer to get back the funds paid for the courses if he/she decides to refuse them at the beginning of the training.

The position of the applicants is that such conditions are contrary to the current Russian legislation, in particular, to the law on the protection of consumers’ rights. Its norm provides for the possibility of refusing the service provided, subject to payment of the actual costs incurred.

At the same time, the terms of the offer provide for the client's right to receive the amount paid by him in 100% of the volume only within three days from the date of transfer of funds, and within two weeks from the date of purchase of the course, only 30% of the total amount can be returned.

However, access to courses in some cases is provided only a month after the purchase. Thus, a potential student is deprived of the right to evaluate the quality of the purchased service and refuse it in case of an unsatisfactory result, compensating only the actual costs incurred.

The current situation is highly likely to lead to a positive decision for the plaintiffs, which, according to a number of experts, will affect the industry as a whole. In this case, other educational platforms may voluntarily change the conditions for the return of funds, or they will begin to provide access to courses immediately after payment, so that there is a basis for deducting the costs incurred, Kommersant reports.
