THE APPEAL CONFIRMED THE DECISION ON THE SUBSIDY FOR THE DEBTS OF FINPROMBANK
The dispute on subsidiary liability for the debts of a credit institution totaling about 30 billion rubles has been conducted since 2019.

The Court of Appeal agreed with the Moscow Arbitration Court on the issue of bringing entrepreneur Andrey Barinov to subsidiary liability for the debt of Finprombank (case no. A40-196703/2016). The businessman is a former CEO and co-owner of the customs payment operator "Customs Card". The amount of his responsibility was previously estimated at 29.5 billion rubles.

In June of this year, the court of first instance again considered the application of the Deposit Insurance Agency (DIA) to prosecute former top managers of Finprombank in a subsidiary manner, having satisfied part of the requirements to Barinov. The courts noted that the ex-tops concluded transactions that caused damage to the debtor by 15.3 billion rubles.

In 2019, the deposit insurance agency filed a lawsuit against 19 former top managers of Finprombank. Then the court rejected the claims against 15 defendants and prosecuted only 4. Later, the AC of the Moscow District found that Barinov was the beneficiary of transactions that caused damage to the credit institution. Thanks to these transactions, the loan debt of Barinov and the "Customs Card" in the amount of about 1 billion rubles was written off.
