The property of the state budget debtors will be pledged.

From now on, tax authorities will have the right to pledge the property of their debtors by force of law in certain cases (paragraph 2.1 of the article 73 of the Tax Code of the Russian Federation). Among such cases there are: 

• The financial recovery of the tax authority with seizure of property and non-payment of this recovery within a month;

• The failure to comply with a decision of the tax authority, by which it was forbidden to alienate or pledge property without the consent of the tax authorities; however, the decision should enter into force.

Thus, the Tax Inspectorate is getting closer and closer to the law on the pledge of their debtors in case of their bankruptcy, which may lead to the advantage of the fiscal authorities over other creditors - we have already written about such an intention.

If the tax authorities get what they want to, then the bankrupt creditors will start having a hard time, since the chances of getting their money after selling the property, part of which will automatically be pledged by the inspection, will be lower and lower.
