AVITO'S FORMER LOGISTICS PARTNER HAS SUSPENDED OPERATIONS
ExMail, which was Avito's logistics counterparty, became involved in the bankruptcy process. This happened after his deal with a popular online marketplace was terminated. The legal entity that operated the courier service, the Ixmail Group of Companies, has stopped operating with a debt of over 600 million rubles.

On January 9, 2025, the company filed a lawsuit with the Moscow arbitration court against KEH Ecommerce, which manages Avito's activities (case no. A40-3/2025). 1,129,417,724 rubles were demanded from the defendant. This amount is calculated as compensation for lost profits.

The partners fell out in the fall of 2024. According to the persons representing ExMail, the contract was terminated unilaterally, although the partner fulfilled the obligations properly. In the lawsuit itself, the company refers to a project according to which it was supposed to create a network of PVZ (order pick-up points) under the Avito and ExMail brand.

The company managed to spend more than 1.5 billion until the moment when the opposite side notified it of the termination of cooperation in August last year. After that, both participants in the litigation discussed the terms of how to repay their mutual obligations. At the same time, according to ExMail representatives, the company was funded exclusively from its own funds for four months (from September to December).

Avito representatives explain the company's decision to terminate the deal with a significant number of complaints sent by the company's customers. They turned out to be 30% more than the usual figure. Customers complained about the loss and damage of parcels. The organization believes that the company has fulfilled its financial obligations to ExMail in full, and the last shipment was delivered at the end of 2024.

The crisis situation has already led to numerous lawsuits. In November-December, ExMail received 36 lawsuits. Their sum amounted to 20 million. Microfinance institutions (in particular, Fordevind and Money Capital) have notified the company of their intention to initiate insolvency. In turn, the courier service requires to cancel the termination of its transaction with Avito by introducing security measures against the counterparty's assets.

According to experts, it is extremely difficult to prove the amount of lost profits in such cases. The court will have to find out the validity of the defendant's claims to the quality of ExMail's work and carefully examine what sanctions were provided for in the contract. ExMail is currently trying to restart its business by negotiating with Lamoda to reformat the PVZ network under its brand. However, a Lamoda representative clarified that no final agreements have been reached yet, and discussions will continue in 2025.
