FEDERAL TAX SERVICE AND CUSTOMS SERVICE MAY BE EMPOWERED TO INITIATE CLAIMS
The Ministry of Finance proposed to empower the Federal Tax Service and the Federal Customs Service with the right to intervene in the case by analogy with prosecutors.  This means that tax and customs authorities will be able to independently initiate cases in defense of an indefinite circle of persons, as well as to enter the processes under consideration at any stage as a party.

The initiative has already been formalized into a draft law, which is posted on the portal of regulatory legal acts and is currently undergoing procedures for public discussion and anti-corruption expertise.

The explanatory note indicates the need to secure the right of the state bodies and local self-government bodies to intervene as a party or even a plaintiff in the interests of an indefinite circle of persons.

In this case, the public interest, in defense of which such plaintiffs will act, will be determined by them independently.

So far, the innovation may appear for tax and customs authorities as part of the work on currency control and the fight against dubious currency transactions.

In particular, the Federal Tax Service and the Federal Customs Service will be able to obtain the right to initiate processes of invalid transactions if there is reason to believe that such agreements violated the currency regulation legislation.

If the draft law is adopted, it is assumed that it will come into force 180 days after its official publication.
