THE COURT RECOVERED MORE THAN A MILLION FROM THE EX-MANAGER

The ex-manager of the Dimitrovgrad Meat Products Plant (Dikom LLC), Alexey Chingaev, must pay 1,122,580.64 rubles as losses inflicted on the organization. The cassation instance in Kazan came to this conclusion. The court considered the complaint filed by the Arsenal insurance company and reduced the amount of damage. Lower courts had previously ordered to recover 2.3 million rubles from the ex-manager.

Oksana Okhlopkova filed a petition in the bankruptcy case of "Wild" (No. A72-1628/2015). In her statement, she pointed out that Chingaev, by his actions, caused losses to the plant in the amount of 3.3 million.

In the role of the arbitration manager, Chingaev was in the period from the beginning of January to August 15, 2018 (7.5 months). At that time, he signed a contract with the company "Organic-AgroSimbirsk" for the storage of electrical facilities. Under the contract, the company could transfer the property to "Wild" for rent.

At the same time, the "keeper" did not incur almost any expenses, receiving financial benefits in the form of lease payments. According to Okhlopkova's calculations, for 22 months of the contract, the bankrupt company received less than 150 thousand rubles a month. At the same time, the objects transferred to another company were not included in the bankruptcy estate. Thus, Chingaev violated paragraph 4 of article 20.3 of the relevant law.

In the beginning, Okhlopkova's claim was satisfied by two judicial instances, however, the cassation decided that the lawsuit should be reviewed anew. Upon reconsideration of the issue, the arbitration recalculated the amount of losses.

In addition to the amount for the period of Chingaev's tenure as manager, money was collected from him for the period up to April 2019. During this period, the functions of the bankruptcy trustee were performed by Evgenia Manoylova and Maxim Dobychin (from January 22, 2019 to April 21, 2019).

In January 2023, the court brought Dobychin to criminal responsibility for embezzlement of property and illegal turnover of financial resources. He received three years probation. According to the verdict of the court, he was fined 100 thousand rubles and ordered to pay 826.5 thousand in favor of "Wild".

The cassation, which received the claim in the case of Chingaev, reduced the amount of his liability to 1.12 million. The amount included only those funds that the combine did not receive during the period when the arbitration manager performed his functions.

Recall that the meat processing plant "Dikom" in the early noughties was under the control of Samara deputy Mikhail Rodionov. In 2005, he established a new structure (Komsomolsk Meat Processing Plant) and transferred the staff of Dikom to it. In 2011, Rodionov's firm declared its own bankruptcy, finding itself in debt for 150 million rubles. A few years later, the "Wild" himself went into insolvency.
