On September 7, the Tambov arbitration received an application from the regional department of the Federal Tax Service (FTS) demanding that the Specialized Developer Techcom (LLC) be declared insolvent. The company is registered in the city of Michurinsk. The amount of the claim is 7,998,860.18 rubles (case A64-8267/2023).


The court left the application of the tax authorities without movement until October 6, 2023, giving the fiscal authorities the opportunity to eliminate the procedural errors. The employees of the Federal Tax Service forgot to accompany the application with an extract from the Unified State Register of Legal Entities and confirmation of the defendant's notification of the need to pay the debt.

The specialized Developer "Techcom" was established on the territory of the Tambov region in August 2019. As a specialized developer, the company participated in the construction of residential and non-residential real estate.

The beneficiaries of the company, according to data from open sources, are Galina Sokolova and Galina Dubrovskaya. The organization is headed by Yuri Prokudin. According to data for 2022, the Specialized Developer "Techcom" received revenue in the amount of 28.1 million. At the same time, as Kommersant writes, the company's net profit amounted to only 455 thousand rubles.

Techcom itself also does not abandon attempts to recover the debt from the "First Construction Company" owned by businessman Oleg Semenov. In early September, the firm applied to arbitration with a claim for bankruptcy of the defendant, indicating claims in the amount of 26.8 million rubles (case no. A64-8069/2023).

The reason for the insolvency was the development project of the Tambov territory with an area of 4.4 hectares. The First Construction Company signed a contract with local authorities back in 2016. In August 2020, Techcom contributed 26.6 million to the project as an investment, hoping to get 400 sq. m. meters of housing.

"The first construction company" already in November 2020 appealed to the city administration with a request to extend the validity of the contract, pointing to force majeure. However, I did not find support from local officials. Techcom appealed to the court, demanding to cancel the investment agreement. In March 2023, the arbitration upheld the plaintiff, declaring the contract invalid (case no. A64-438/2022). After an unsuccessful appeal in the appeal, the judicial act entered into force on July 13, 2023.

Considering the request of the Specialized Developer "Techcom", the court refused to accept the bankruptcy application of the "First Construction Company", referring to Article 453 of the Civil Code of the Russian Federation. The court Ruling says that by September 1, 2023, the defendant's obligation was not overdue, that is, there are no grounds for bankruptcy. As a result, Techcom appealed the judicial act to the appellate instance (19th AAS).
