The temporary manager of Svyaznoy Network LLC stated in court that the company had signs of fictitious bankruptcy. He applied for the opening of bankruptcy proceedings, although the first creditors' meeting had not yet been held. The court had previously banned the first meeting before the claims of a number of companies totaling 41.8 billion rubles were considered.
During the court session, the creditors supported the opening of bankruptcy proceedings, regardless of the inclusion of their claims in the relevant register.
According to the telegram channel RIA Novosti: arbitration cases, interim manager Anton Sychev made a conclusion about deliberate bankruptcy based on two facts:
• The loan repayment period and the issuance of such loans to related parties were extended at a time when the company was already in a difficult financial situation. • Svyaznoy wrote off debts on these transactions to the reserve with an indication of the low probability of a refund. • Taken together, the above facts led to a deterioration in the financial situation of the organization, which allows us to conclude about deliberate bankruptcy.
As part of this case, Anton Sychev has already sent an appeal to the prosecutor's office and the Ministry of Internal Affairs about the fictitious bankruptcy of the company. Next, a criminal case will be opened, operational search measures will be carried out and a circle of suspects will be determined.
