CREDITORS OF THE FIRST NON-RESIDENT BANKRUPT IN THE RUSSIAN FEDERATION DECIDED NOT TO PAY FOR THE PROCEDURE
Recently, a meeting of creditors of Pandora Consulting LS, the first non-resident firm in Russia, whose insolvency was officially recognized in court, took place. The only participant in the event was a representative of Vitaly Nakhabin, whose claims amount to about 1.3 million (about 52.3% of the total debt). As a result, it was decided that the bankruptcy procedure would not be financed by creditors.
This bankruptcy case (No. A76-31539/2021) has become a landmark case for litigation in Russia. Until 2022, the courts were cautious about the possibility of recognizing the insolvency of foreign organizations.
The situation changed after the decision of the Chelyabinsk arbitration court. He transferred a foreign company to bankruptcy proceedings. This was done on the initiative of Vitaly Nakhabin, whose requirements for the organization were based on a court ruling. The firm tried to appeal the decision, but was unsuccessful.
In June 2022, the Bankruptcy Trustee Vitaly Brevnov shared information that the organization does not have any assets at the expense of which it is possible to finance the process. The conducted inventory showed the absence of accounts receivable and other valuables. But soon there was a change of manager.
Pavel Novikov, the Bankruptcy Trustee who took over the role, announced in early 2024 that a foreign organization still has some assets. In particular, he managed to find 67.5 million accounts receivable. Shopping centers (220 objects of office equipment and 19 pieces of furniture) were also identified. Their cost has not yet been estimated. However, nothing prevents you from trying to sell the identified assets at auction.
Debtors of a foreign company whose claims can be put up for auction are Mikhail Grebnev, Impulse and MosAlka Bau companies. Accounts receivable in respect of the company "Axiom No. 1" and entrepreneur Oleg Gushchin at the last meeting of creditors, it was decided to write off.
