Former employees of the Russian "daughter" Oracle (Oracle Computer Equipment) They may be required to return the money received as bonus payments shortly before the bankruptcy of the company. The bankruptcy trustee (KU) Egor Nepomnyashchy reported on the contestation of transactions that became the basis for the payment of bonuses in the amount of 50 million.

In August 2023, Rusbankrot already wrote about the bankruptcy of Oracle's daughter in Russia. The firm, established in 1997, raised 7.8 billion in revenue in 2021, showing a loss of 75.7 million. In March 2022, the company stopped providing services to its customers (including the Federal Tax Service, the Central Bank, Rostelecom, Sberbank and others), announcing the dismissal of 300 employees and withdrawal from the Russian market.

About a year ago, the organization received the status of bankruptcy. The initiator of the process was one of the counterparties who applied to arbitration at the end of 2022. Soon, banks, mobile operators, IT structures and other organizations were added to the list of creditors of the company. All of them were not satisfied with the sudden departure of an international corporation from the Russian Federation, which had not fulfilled its obligations.

The bankruptcy trustee demanded that the former heads of the company and its shareholders be involved in the subsidy. The bankruptcy estate, in particular, could be replenished by some subsidiaries of Oracle. However, now it has come to the payments that the employees of the Russian company received after the company's statement about leaving the country.

According to Fedresurs, 15 lawsuits challenging the accrual of bonuses have already been filed. The amount of claims for them is about 50 million. KU plans to submit 36 more applications in the near future. In his opinion, cash payments were accrued on the eve of bankruptcy intentionally, in order to reduce the bankruptcy estate of the bankrupt structure.

According to experts cited by RBC, the bankruptcy trustee has serious chances to recover funds, given the prevailing judicial practice. To do this, the court will consider whether the employees of the organization were aware of its financial condition, to what extent the amount of the accrued bonus corresponds to the completed work results.

The defendants in the list of persons whose bonus payments are disputed by Nepomnyashchy are Evgeny Dryakin and Alexey Kurochkin. KU will try to collect 8.4 million and 9.3 million from them, respectively. Dryakin was the head of Oracle Communications. At the moment, he manages the Omega Telecom Development company, in which he is a co-owner. Kurochkin held the position of Senior Managing Director of Oracle Cloud Systems in the CIS. Since June, he joined the YDB department (Yandex department, DBMS manager).
