In order to exercise this right, a person brought to subsidiary liability will need to file a petition with the arbitration court considering the bankruptcy case.
The State Duma adopted in the first reading a bill aimed at improving the law on insolvency. According to it, those brought to subsidiary liability for the obligations of the bankrupt will be entitled to challenge the creditors' claims.
Thanks to changes in the legislation, citizens involved in the subsidy will be able to reduce the bankruptcy estate through the court. At the moment, there is no possibility to appeal the court's decision in such cases.
Filing an application for participation in an insolvency case will not be considered an admission of the debtor's guilt in bankruptcy and will not become a basis for bringing to responsibility, TASS notes.
The bill (N132289-8) was submitted by the Government of the Russian Federation to the State Duma in May 2022.
