SUPREME COURT: DRIVER'S LICENSE DOES NOT CONFIRM IDENTITY
A driver's license does not certify the identity of a citizen. This conclusion was reached by the Supreme Court of the Russian Federation following the consideration of the cassation appeal in the case (No. 46-AD22-15-K6) on bringing a citizen to administrative responsibility for violating the rules of transportation of dangerous goods.


The courts of three instances terminated the proceedings on bringing a person to responsibility due to the absence of the composition of an administrative offense.

The Supreme Court of the Russian Federation has changed judicial acts in terms of motivation, indicating that the proceedings in the case are subject to termination due to the expiration of the statute of limitations.

In addition, in its resolution, the board noted that in the classifier of types of identity documents, which was approved by the Board of the Eurasian Economic Commission, there is no driver's license, which only confirms the right to drive a vehicle.

At the same time, it is worth noting that this conclusion is not comprehensive, since for the purposes of legislative regulation in certain areas, a driver's license is recognized as an identity document (see, for example, Order of the Ministry of Health of the Russian Federation No. 130n of 20.02.2021, Order of JSC "Russian Post" No. 230-p of 21.06.2022, etc.).
