VTB BANKRUPTS THE FOUNDER OF INTECH BECAUSE OF THE LOAN GUARANTEE
On March 18, 2024, the arbitration court in St. Petersburg issued a ruling on the introduction of bankruptcy proceedings for Sergei Semkin (case No. A56-80247/2023). The restructuring of his debts has now begun in relation to the founder of the Intech holding. In the third turn of the register, the court included the principal debt to VTB Bank in the amount of over 275 million rubles and a penalty in the amount of 13.4 million, which will be paid only after repayment of the principal debt.

The businessman tried to appeal the verdict to the court of appeal, but the court temporarily left his application without motion. According to the appeal, Semkin violated procedural norms (paragraph 3, part 4, Article 260 of the APC of the Russian Federation) by not attaching proof of notification of the creditor bank to the complaint. The entrepreneur can correct the mistake until May 3, 2024.

The basis for the litigation was VTB Bank's lending to Intech holding in 2021, in which Semkin acted as a guarantor. The case file also reports on bank guarantees in the amount of over 780 million rubles in favor of several companies (NLMK, Severstal, Kama-Cardboard, etc.).

During the consideration of the case, Semkin's representative managed to reduce the amount of the penalty by almost 4 times. Initially, VTB demanded to charge 54.5 million rubles. The next bankruptcy hearing is scheduled for July 2024. The arbitration approved Enver Motskobili, representing the association of AU "Parity", for the role of financial manager.

It should be recalled that Intech Holding was a contractor in the process of constructing automobile plants, a tobacco factory and other large facilities. In 2020, the company's revenue amounted to 1.4 billion rubles. By 2022, it has become less than 14 million. In 2023, the company did not receive any revenue at all. Over the past few years, the loss amounted to 869.3 million.

The contract related to the modernization of the Severstal plant (Cherepovets) turned out to be unsuccessful for the company. The company was granted bankruptcy status and since March 2023 it has been transferred to the bankruptcy procedure.

The construction and installation holding continues its litigation with the Severstal plant, trying to recover over 415 million from the defendant. Experts suggest that inconsistencies in the assessment of the cost of work could be the basis for legal proceedings. An expert examination has been appointed in the case, which is likely to become the basis for a court decision.
