The Kalininsky court of St. Petersburg had to consider a civil lawsuit filed by a man against his ex-girlfriend. Mikhail Panev demanded to return 160 thousand as unjustified enrichment. However, the court refused the citizen.


During the trial, it turned out that Nadezhda Klenova and Mikhail Panev had been dating for several years since 2016. The court qualified their relationship as "guest cohabitation". The couple did not run a joint household, and citizens transferred money to each other as needed to bank cards, making joint purchases.

After a while, Klenova discovered that Panev had a sexual relationship on the side. The woman decided to end her relationship with her lover.

As the defendant reported, for some reason the plaintiff was offended and decided to take revenge on Klenova in court.

Panev calculated that during the period of communication with Klenova he transferred 192.92 thousand rubles to her account. Part of the money (62.3 thousand) was returned, and the rest of the ex-girlfriend did not want to return. Then Panev demanded the return of 130.62 thousand through the court. He also did not forget to indicate in the claim the interest accrued in connection with the defendant's misuse of his money. Their amount was subsequently increased from 23 thousand to 35 thousand.

However, the court justly refused the citizen, taking the side of the defendant. The plaintiff did not provide any written evidence that the money was transferred as a loan. He also carried out the transfer of money personally and voluntarily. Thus, the court decided, the funds were a gift, transferred free of charge. The fact that the relationship between a man and a woman has ceased is not a reason for the return of money donated earlier, the court said.
