THE EMPLOYEES OF THE INSTRUMENT-MAKING PLANT FAILED TO CHALLENGE THE VACCINATION REQUIREMENT
The story happened in Ulan-Ude: the management of JSC "Ulan-Ude Instrument-making Production Association" issued an order on mandatory vaccination and revaccination of all employees of the enterprise from coronavirus infection.

In turn, some of the employees refused to perform, as a result of which it was decided to suspend them from work. Then an order was issued to declare downtime for them and pay wages in the amount of 2/3 of the official salary.

Challenging these actions of the company's management, as well as demanding to pay wages in full and compensate for moral damage, the employees referred to the violation of the requirements of the order of their constitutional right to vaccination. In addition, the employees indicated that the requirement to pay 2/3 of the official salary is illegal, since the plaintiffs do not receive an official salary.

The court did not agree with these arguments.

The court in the final decision indicated that the disputed order was adopted in full compliance with the requirements of epidemiological legislation and by-laws adopted in its execution, which is why the employer was obliged to vaccinate at least 80% of employees.

Regarding the announcement of downtime, the court also pointed out that this decision was made by the employer in full compliance with the law, since due to the specifics of the company's activities and the organization of work on it, remote work of employees is impossible, and the announcement of downtime was the only possible option for the employer.
