PHOSAGRO-RELATED FIRMS HAVE FILED LAWSUITS AGAINST EUROCLEAR IN THE ASGM
The Cypriot companies Gekolina Investments and Perprecia filed statements of claim (cases no. A40-231669/2023, no. A40-231664/2023) to the Arbitration Court of Moscow against Euroclear and the Cypriot subsidiary of Renaissance Capital Renaissance Securities. In total, Gekolina Investments intends to recover about 7 billion rubles, and Perprecia – 2.2 billion. The reason for filing both claims was the freezing of assets on Euroclear accounts.
Consideration of the claims is scheduled for December 6 (Gekolina Investments) and November 7 (Perprecia).
The respondent organizations are owned by Chlodwig Enterprises and Adorabella. Previously, these companies were registered in Switzerland. At the end of 2021, they were the owners of 43.66% of Fosargo. In 2022, the organizations re-registered in the Kaliningrad Region and became holders of the status of international companies Adorabella and Clovis Enterprises.
The submission of a claim by Cypriots to the ASGM to a foreign partner is possible due to the introduction of amendments to the Arbitration Procedural Code (APC) of the Russian Federation. Thus, Article 248.1 of the Agribusiness Code established the exclusive competence of Russian courts in the framework of disputes involving foreign sanctioned persons in the event that sanctions against Russian persons became the basis for such disputes.
Earlier, Russian companies have already filed claims against Euroclear. Thus, the First Management Company, Ural Bank for Reconstruction and Development, MTS-Bank, Rostselmash, Energia-Invest Management Company, a number of private investors and a group of citizens demanded to recover funds from the depository.
