NATURA SIBERICA WAS "SAVED" FROM A CLAIM OF 4.1 BILLION RUBLES
The Arbitration Court of the Moscow Region rejected En+ Recycling and Ingosstrakh in a lawsuit against First Solution LLC, whose main legal entity is Natura Siberica. The plaintiff demanded compensation from the defendant in the amount of 4.1 billion rubles for the fire that occurred in March 2020. This is stated in the file of arbitration cases.

The incident destroyed 80% of the buildings of the industrial zone of the plant on an area of 60,000 sq. m. The applicants believe that the fire occurred in a room rented for a Natura Siberica warehouse as a result of welding work. The tenants denied holding them there and claimed that the cause of the fire was the emergency operation of the lamp.

The trial was repeated, initially the court partially satisfied the claim and recovered 1.49 billion rubles and 1.37 billion rubles in favor of the plaintiffs. The basis for the decision was the expertise carried out, according to which the fire occurred due to electric arc welding. The defendant requested a re-examination, but it was refused.

According to the lease agreement, Natura Siberica received the premises in working condition, which the tenant had to maintain. Also, the "First Solution" was responsible for the security of the premises. The Arbitration Court of the Moscow District did not agree with this and sent the claim for reconsideration. According to the cassation, the authorities were obliged to find out the cause of the fire. In addition, since the parties have not signed the act of differentiation of operational responsibility, the risk of accidental damage to the property lies with the owner.

After the examination, the plaintiffs' claims decreased from 4.1 billion rubles to 1.89 billion rubles of real damage and 419 million rubles of lost profits. However, the court refused the plaintiff in these requirements.
