MEGAFON WILL BANKRUPT THE "DAUGHTER" OF ORACLE CORPORATION
The Russian telecom operator announced its intentions to initiate the insolvency process of Oracle Computer Equipment.
The relevant information was published by PJSC MegaFon on the Fedresurs website.
The reason for bankruptcy in the documents is the refusal to fulfill contractual obligations and failure to comply with a court decision.
Experts suggest that we may be talking about the July verdict, according to which the "daughter" of a well-known American corporation had to pay 44.1 million rubles to Megafon.
Oracle worked with the Russian company through its subsidiary, concluding contracts for the supply of software and technical support. According to one of these contracts, Megafon carried out a full pre-payment of services in the amount of 105.6 million rubles. At the same time, the day before that, the company announced that it was ceasing economic activity in Russia.
On March 4, the company really stopped providing technical support to MegaFon. An attempt to send a claim to the counterparty and demand a refund of the overpayment for services that were not actually rendered did not bring success. As a result, MegaFon appealed to arbitration. The court upheld the claims, and the defendant did not challenge the court's decision, as, indeed, he did not pay the debt.
It is worth noting that Megafon is far from the only Russian company interested in collecting a large sum of money from Oracle. Before the start of the special military operation, the products of the American corporation (software, DBMS, server equipment) were used by many Russian structures (the Federal Tax Service, Sberbank, the Central Bank of the Russian Federation, Rostelecom). The revenue of the Russian "daughter" of the American developer reached 7.8 billion rubles.
After the American corporation announced its withdrawal from the market and its intention to dismiss about 300 of its employees in Russia, Marvel Distribution, Croc Incorporated, Infosystem Jet, IBS Platformics, Taber Trade and others filed claims with Oracle.
The total amount of financial claims against Oracle from former Russian partners in a few months quickly exceeded 300 million rubles. At the same time, until February 2022, there was practically no talk of Oracle litigation with counterparties. The only exception for the last two years was a Pension fund with a claim to the company in the amount of 6 thousand rubles.
