Dutch company Minikim Holland B.V. applied to the court with a claim for illegal use of the brand’s logo. The ex-vocalist of the Serebro group allegedly placed a world-famous image on the cover of her single without permission.

Before that, there were no such precedents in our country, despite the fact that Russia is one of the key places for the sale of company’s products. Basically, the image of a famous couple of lovers from the cover of bubble gum, which was popular in the nineties, is used on Valentine's Day.

Elena Temnikova's rash act may result in serious losses for her, since the trademark owner was offended in earnest and is preparing for a judicial war.

Minikim Holland B.V. believes that the company suffered serious losses from the actions of the Russian artist. The materials of the lawsuit say that Elena Temnikova placed an image of Love is ... on the cover of the label and sold clothes with a ‘couple in love’ on her website without the consent of the copyright holder.

The claim will be considered by the arbitration court of the Omsk region. It was filed on June 30, but has not been registered yet.

The owner of the brand wants to sue Elena Temnikova for 3 million rubles.

This figure was determined by the value of the contract, which could be concluded by both parties. Everyone can be convinced that the trademark owner is right. The single with the cover of Discord is available on popular streaming services. The heroes are really very similar to the boy and girl from Love is… bubble gum. It is noteworthy that immediately after the pre-trial claims, the T-shirts were removed from the website.

According to Kommersant, the applicant's representative - the CEO of Semenov & Pevzner, Roman Lukyanov, said that pirated copies of the brand hit the copyright holder's pocket hard. There are several more lawsuits against the violators ahead.

The official representative of the ex-vocalist of the Serebro group shortly stated that they had not received any statement of claim.

Zakhar Nazarenko, the development manager of the Love is ... brand in the Russian Federation, stated that the brand loses 10 million rubles annually due to the actions of ‘pirates’.

Experts note that most likely, the court will side with the plaintiff if he can prove that the original drawing was used without any changes, but only in the case of T-shirts. At the same time, the brand's trademark did not go through the registration procedure for the services of organizing concerts. So this part of the argument is unlikely to be won.
