GARIK MARTIROSYAN IS SUED FOR A PHOTO OF VORONEZH

The Moscow Commercial Court will consider the claim of the Belgorod agency for the protection of the rights of photographers "Landscape" against the comedian Garik Martirosyan. The declared amount of the claim is 100 thousand rubles.



It is known that the plaintiff represents the interests of the photographer Ruslan Aptiev. The case information states that back in 2018, Martirosyan used a photo on his Instagram, the copyright of which belonged to the photographer. The picture showed the views of Voronezh - the Annunciation Cathedral and the Voronezh-1 railway station.

The comedian used the photo as an announcement of the Voronezh concerts in 2018 and 2019.

It is noted that the amount of 100 thousand rubles is the double cost of using the picture under the agreement between "Landscape" and Ruslan Aptiev. The plaintiff noted that Martirosyan took the author's photo for commercial purposes, but even if we assume that this was not done for promotion purposes, the owner’s consent was required for publication.

It is assumed that the photographer missed not only the benefit, but also a portion of fame that he could have received, if Martirosyan had put his name under the photo. It is worth noting that the comedian refused from a pre-trial settlement.
