On March 14, the Arbitration Court of Belgorod received a bankruptcy petition from the Canning Vegetable Plant, located in Stary Oskol. The initiator of the process - the trading house "Oscar" - requires almost 600 thousand rubles from the organization. The date of the court hearing in the case (No. A08-2219/2022) has not yet been set, and the claim itself has not yet been accepted for proceedings.
However, this is not the first attempt of TH "Oscar" to drive its counterparty to bankruptcy. A similar application was filed by the plaintiff at the end of 2021 (case No. À08-13185/2021). By the time of consideration, the initiator of the bankruptcy filed a petition with the arbitration with a claim to terminate the proceedings.
The plaintiff referred to the fact that the defendant does not have any property, at the expense of which it would be possible to pay the costs of bankruptcy.
As a result, the court returned the application back by its decision of January 19.
The litigation between the organizations is based on a product supply agreement signed on July 1, 2017. The plant owed 799,995 rubles to Oscar Trade House, but after receiving the claim, it paid only 200,000 of the entire debt. As a result, the supplier organization was forced to go to court and achieve satisfaction of the claim in full (case No. À08-12655/2019).
According to data from open sources, the Canning Vegetable Plant has been operating in the city of Stary Oskol since November 2016. Until February 2021, the founder of the organization was Vera Dubinkina. On February 24, Anna Reshetnikova became the owner of the enterprise. She is also the head of the company. In 2020, the plant received revenue in the amount of 13.185 million rubles, earning a profit of 179 thousand rubles.
In 2021, the plant was sued by the credit institution. FC ‘Otkritie’ demanded to recover a debt in the amount of more than 1.2 million rubles from the enterprise.
As a result, the claim was fully satisfied (A40-111396/2021), and the loan agreement with the bank, concluded in October 2019, was terminated by the court.
