April Fools' lawsuits: why the Musatovs made a decision to drive the subsidiary of Auchan to bankruptcy
April Fools' lawsuits: why the Musatovs made a decision to drive the subsidiary of Auchan to bankruptcy
Several bankruptcy claims were submitted to arbitration on April 1, 2022 from individuals against the Atak company. The details of the cases (No. A40-67445/2022, No. A40-67435/2022 and No. A40-67378/2022), which came to different judges of the Moscow court, are still unknown. Considering the moratorium imposed on the initiation of such processes by the country's authorities since April, all of them may turn out to be an April Fool's hoax.
We should remind our readers that that Atak LLC is a subsidiary of Auchan in Russia, which also manages the Leroy Merlin and Decathlon brands. Hypermarket chains are part of the French group of companies Auchan Retail, owned by the Mullier family. Represented in 17 countries, the company has been operating in Russia since August 28, 2002 and, according to the statement made earlier, is not going anywhere.
At the end of 2015, AUCHAN united four retail formats, including Atak supermarkets.
The Atak company in 2020 received the revenue of 52 billion rubles, but the year turned out to be unprofitable - 2.9 billion rubles were missing.
According to experts, the initiators of bankruptcy are Svetlana, Inna and Alexander Musatov. Individuals became creditors of the company as a result of the assignment agreement, having acquired the right to claim for 150 million rubles of debt. Moreover, the obligation itself arose in connection with the lease of commercial space leased by an unscrupulous owner.
It turned out that the landlord acquired the property rights to the object as a result of a void transaction. Moreover, the management of the Atak company knew about this at the time of the conclusion of the lease contract, which means that it acted in bad faith. As the @ruarbitr Telegram channel reports, the property had been previously registered by Lada Engineering Invest Company JSC, which was declared insolvent.
