A resident of Moscow challenges the right to hospitalization without vaccination in court
Nina Ostanina, a candidate for deputy of the State Duma of the Russian Federation of the new convocation, applied to the Moscow City Court with a claim.  The woman is trying to challenge the order of the Moscow health department, adopted this summer.  The document prohibits the planned hospitalization of persons who have not been vaccinated or have not recovered from a new coronavirus infection.

The challenged normative act was issued in June this year against the backdrop of an increase in the incidence of COVID-19 in Moscow. Then the number of detected cases reached 9 thousand daily.

The position of the department was that the order is temporary and is aimed at protecting patients, since those who are being treated in the hospital have weak immunity, and there is simply no way to isolate each person.

In addition, the officials recalled that the restrictions are not applied in case of emergency hospitalizations, as well as for people who have contraindications to vaccination, reports Kommersant.

The plaintiff, in turn, insists that the order discriminates against patients without antibodies, which is unacceptable at the level of federal law, while the order was issued at the regional level and must comply with the higher acts. In her claim, Ostanina demands to recognize the order issued by the Moscow Department of Healthcare as illegal.
