On July 20, an open hearing on the case of Private Zakhar Kukareko is to be held in the garrison military court of Ryazan. A soldier dismissed from the armed forces of the Russian Federation is trying to appeal against the entry in the military ticket made by the commander of the unit about the tendency "to betrayal, lies and deception."
The corresponding "mark" was entered into the document in the form of a red seal after the private refused to participate in a special operation on the territory of Ukraine. The lawyer representing his interests, Maxim Grebenyuk, considers this record illegal and intends to seek its cancellation together with his client.
According to the defense, such a record complicates the life of a young man and his subsequent employment.
As Grebenyuk noted in the telegram channel "Military Ombudsman", it was about the difficulties in finding a job after his dismissal that Kukareko told the judge, who asked about the influence of the press on his current life.
Judging by the photo of the military ID card published on the Internet, the entry humiliating the dignity of the dismissed soldier was made by Captain Zharov, who served as the head of the personnel department in the 136th Guards Motorized Rifle Brigade. The military unit itself is stationed in Dagestan.
According to the information posted on the court's website, the application filed by Kukareko was registered on June 29, 2022. The defendant in it is the commander of military unit No. 41450.
Lawyer Grebenyuk told reporters that the reason for the private's refusal to participate in a military special operation in the Donbas was his previous seven-month military experience during a business trip in Syria. After returning to Russia, Kukareko expected to receive a legal rehabilitation leave, and not a new order to participate in hostilities.
Earlier, the telegram channel "War with Fakes" posted a photo of a document of a serviceman with a seal about a tendency to betrayal. In the comments to the publication, it was noted that this image is a fake, since such "tags" do not officially exist in Russia.
According to the authors of the publication, refusal to comply with the order threatens the serviceman with criminal liability.
Subsequently, this message was re-published in the official telegram channel of the Ministry of Defense.
However, as the lawyer Grebenyuk noted, it is impossible to initiate a criminal case in the case of Kukareko, as well as to put an ordinary soldier in the guardhouse. Those lawyers who consider orders to participate in a special operation to be obviously illegal agree with him, since this is due to the crossing of the borders of the Russian Federation and another state (in this case, Ukraine) violating the requirements of the legislation.
