The manager applied to the court for the establishment of expenses and remuneration for the bankruptcy proceedings (case no. A41-22526/16).
The courts of two instances partially satisfied the application, pointing out that the manager can only be paid expenses within the limits of the funds held in the court's deposit account, in the rest of the claim is subject to rejection, since the applicants in the bankruptcy case had previously refused to finance the procedure.
The cassation annulled the judicial acts in part and satisfied the requirements of the manager, based on the fact that in this dispute there is no evidence indicating the establishment of the maximum amount of financing. The applicants' oral explanations referred to by the courts are not such. In addition, the judicial act, which established the circumstances of such explanations regarding the financing of the procedure, was canceled.
Considering the above, and also taking into account that the arithmetic calculation of the claimed claims has been established, the courts had no grounds for refusing to satisfy the manager's application for recovery from the applicants to pay the remaining part of the remuneration and expenses incurred during the bankruptcy proceedings.
