YAMAL LNG BUILDER DEMANDS 130 MILLION FROM THE ARBITRATION MANAGER OF URENGOYMONTAZHPROMSTROY
On March 6, 2024, the Mechanization Company (JSC) applied to the Tyumen Arbitration Court (AC of the Tyumen region) with a statement on the joint recovery of losses from the arbitration managers of Urengoymontazhpromstroy (UMPS). The company demands from Alexey Polishchuk and Alexander Batin joint and several damages in the amount of more than 130 million (case no. A70-4568/2024). The organization considers the negligent attitude of the managers to their professional duties to be the basis of the claim.

UMPS (JSC) was a contractor in the NOVATEK (Yamal LNG) construction project. Subsequently, the company was declared bankrupt (case no.A81-5638/2015). Polishchuk, representing the self-regulating organization of arbitration managers of the Central Federal District, was the bankruptcy trustee from February 6, 2017 to December 2, 2019. Batin was approved for this role by a court ruling dated December 24, 2019.

During the bankruptcy process, the former head of the Board of directors of UMPS and its co-owner, Alexander Kapnik, was involved in a subsidiary. Mechanization, which worked at the Yamal LNG construction site as a subcontractor, received the right to demand 130.4 million rubles of debt from a top manager. At the same time, the court soon declared Kapnik bankrupt, allowing his creditors to apply for inclusion of their claims in the register until October 24, 2019.

However, the bankruptcy trustee Polishchuk did not apply to the court with such a petition, nor did Batin. The Mechanization company lost the right to include its claims in the register because it missed the procedural deadline.

As reported by Pravda UrFO, financial claims in the amount of 1.8 billion were satisfied by the courts against the former management of UMPS. A significant part of the liabilities (1.45 billion) was included in the bankruptcy estate of the bankrupt enterprise. However, former top managers Ilina Botsieva and Alexander Kapnik were obliged to pay 350 million to various creditors. Among them are the tax authorities (100 million) and the company "Mechanization" (130.4 million).
