WHEN TIME IS MORE EXPENSIVE THAN AN ASSET
The manager applied to the court for invalidation of the vehicle purchase and sale agreement between the debtor and the defendant (case no. A56-50715/22).

The courts of two instances refused to satisfy the application, guided by the fact that the transaction was completed within a year before the initiation of bankruptcy proceedings. Rejecting the defendant's arguments about missing the limitation period, the courts considered that the case materials did not confirm that the manager had learned (should have learned) about the conclusion of the contested contract more than a year before going to court.

The cassation refused to satisfy the application, noting that in the materials of the bankruptcy case from 09.01.2023 there was information about the registration of the vehicle for the debtor in 2021, that is, during the year before the bankruptcy case was initiated. Consequently, starting from 01/09/2023, the financial managers in the debtor's bankruptcy case had information about the registration of the car with the debtor in 2021, had the opportunity to find out the fate of the vehicle and clarify the grounds for de-registering it with the debtor.
