VIOLATION OF CONSUMER RIGHTS BROUGHT THE PERM CAR DEALERSHIP TO BANKRUPTCY

On March 4, 2024, the arbitration recognized the insolvency of the UAZ Center Perm car dealer (case no.A50-23954/2023). The process was initiated last autumn by local resident Olesya Yusupova. The basis for the lawsuit was her purchase of a UAZ PATRIOT car, made in January 2019. After the purchase, the citizen discovered that the mileage of the car was twisted. She complained about the poor quality of the product.

In 2020, the Judicial Board of the regional Court issued a ruling on the case (No. 33-5194), confirming the fact of violation of consumer rights. According to the verdict of the court, the car dealer was obliged to pay the buyer almost 160 thousand rubles. This amount included the difference in the cost of a car (65 thousand), compensation for moral damage (20 thousand), a fine (42.5 thousand) and the costs of a lawyer (30 thousand), an appraiser and an expert.

Since the car dealership was in no hurry to pay the woman the debt approved by the court, she appealed to the district court. In February 2021, he issued a decision to recover 999.9 thousand penalties and 499.95 thousand fines in favor of the consumer. During the subsequent litigation, the amount of claims increased by another 100 thousand due to fines and penalties, amounting to about 1.6 million rubles.

In January 2024, the arbitration began proceedings on Yusupova's claim. The plaintiff insisted that the process could be carried out according to a simplified procedure. Evidence was presented to the court that the company does not have property or money in commercial bank accounts. The location of the defendant also remains unknown.

According to official data, the car center has been operating in Perm since 2017. The company traded in light-duty passenger and cargo vehicles. The company was the official dealer of UAZ in the Kama region. One of the main customers of the company was the regional main directorate of the Federal Penitentiary Service. Roman Permyakov has now been appointed bankruptcy trustee.
