THE TAX SERVICE WILL BANKRUPT THE ARMAVIR INTERDISTRICT PHARMACY BASE
In Kuban, the court (AS CC), by its verdict, imposed surveillance on the Armavir Interdistrict Pharmacy Base (LLC MRAB). The case was initiated by the tax authorities (Federal Tax Service No. 13 in the Krasnodar Territory), as the company had accumulated a large arrears in mandatory payments to the budget and extra-budgetary funds.
According to the Federal Tax Service, the total amount of debt to be included in the register exceeds 636 million rubles. This amount consists of the principal debt of 530.8 million, almost 50 million penalties and a small amount of fines. Additionally, the service declares the requirements of the second stage for 1.2 million and the third stage for more than 104 million rubles.
A legal entity operating in the market since 1996 and specializing in the manufacture of pharmaceutical products for medicine and veterinary medicine tried to challenge the claim. The debtor's representatives, without denying the debt itself, petitioned to dismiss the case. They referred to the lack of funds to finance the procedure due to the seizure of property in a criminal case involving the beneficiary, Vladimir Ilyichev. However, the court rejected this argument, pointing out that the company has registered assets, the value of which exceeds the requirements stated by the fiscal service.
Financial analysis of the company is difficult: the reporting for 2024 is not available in open sources. The company ended the previous reporting period with a loss of 9 million rubles.
Timur Uzbekov, a member of the SPO Avangard, was appointed to control the arbitration process. Its tasks include assessing the debtor's financial condition, analyzing transactions and preparing an opinion on the possible further development of the bankruptcy procedure.
This case clearly shows how significant tax arrears combined with the legal problems of the owner can lead to irreversible consequences for the business, despite its attempts to avoid legal proceedings.
