The decision of the Moscow arbitration court, which suspended the monitoring procedure of Google LLC earlier, was supported last Monday by the cassation (AS of the Moscow District). The case was considered in connection with the complaint of the interim manager Denis Polyychuk, filed on October 13. A similar complaint was received a week later from the company itself.

Plans for the bankruptcy of Google's "daughter" became known in the spring. The reason was the inability of the company to fulfill financial obligations imposed by the court. First of all, the first revolving fine of 7 billion rubles in the Russian Federation hung over the firm like a sword of Damocles.

In June, the company filed a lawsuit in arbitration. By this time, as Rusbankrot reported, the main part of the organization's staff had been moved outside the Russian Federation, while some employees had left.

In September 2022, the court made a decision regarding Google. The company's lawyers reported that about 1.2 billion rubles were seized on the company's accounts. The firm could no longer fulfill obligations worth more than 19 billion, having assets of only 3.5 billion. As a result, the court established surveillance for six months.

However, at the end of September, the arbitration received a complaint from Roskomnadzor. In it, the agency also petitioned for the suspension of Google's bankruptcy proceedings. It was about the balance of interests that needs to be taken into account in relation to a public creditor. The very consideration of the complaint, as Rusbankrot wrote earlier, was scheduled for November 21.

As a result, the appeal found that the grounds requested by the agency for suspending surveillance comply with Article 265.1 of the APC of the Russian Federation and issued a verdict in which it supported the applicant's petition.

Recall that by this time, the Tagansky court of the capital had confirmed the legality of collecting another 21.7 billion turnover fine, issued this summer. Total accounts receivable reached more than 27 billion, while liabilities to creditors amounted to 18.7 billion.
