THE SUPREME COURT OF RUSSSIA: SMOKING NEIGHBORS ARE OBLIGED TO COMPENSATE FOR NON-PECUNIARY DAMAGES
The head of the Supreme Court of Russia, Vyacheslav Lebedev, outlined the right of Russians to compensation for non-pecuniary damages from smoking neighbors. The statement was made last Wednesday at an international conference on the environment.

The speaker outlined the right of every person to protection from tobacco smoke and recalled the explanations of the Supreme Court on this topic.

The rules of law provide an opportunity to recover compensation for non-pecuniary damage in such cases.

Commenting on the explanations, the chairman of the court recalled that a decrease in the amount of the claimed compensation can occur only in the event of unintentional harm and in the presence of circumstances indicating the difficult financial situation of the culprit.

Lebedev also cited statistical data, indicating that the Plenum of the Supreme Court considered the issues related to the environment more than 50 times, and legal positions on this topic contain more than 150 court decisions.

The anti-tobacco law has been in effect in Russia since the summer 2013.

Entrances, elevators, entrances to train stations, cafes and restaurants, beaches, playgrounds, public transport are among the places free of nicotine. This year, the list included medical institutions, retail outlets, warehouses and even hayfields.
