THE SUPREME COURT OF RUSSIA WILL CONSIDER A QUESTION OF RIGHTS OF DRUNK DRIVERS
In July, the highest court will consider an application to check compliance with the legislation of the established rules for medical examination of drunk drivers. According to the initiator of the process, the current language of laws has some uncertainty.

We are talking about a governmental decree and an order of the Ministry of Internal Affairs on this issue.

The applicant was a man who was detained at the beginning of the year by traffic police officers who discovered that the level of alcohol in his blood exceeded the level allowed while driving.

A certificate of examination had been drawn up, and the court subsequently issued a fine and deprived the man of his driving license.

The arguments of the applicant and his defense boil down to the fact that the certificate of examination was drawn up by one officer, while the actual examination was carried out by another, which is unacceptable.

Consequently, in the applicant's opinion, the order of the Ministry of Internal Affairs ¹. 676 of 4 August 2008 and a governmental decree ¹. 475 of 26 June 2008 create legal uncertainty and the possibility of free interpretation. The applicant believes that due to the vague wording contained in the regulatory legal acts, it is not clear whether one inspector can check the driver and the second one sign the act drawn up on the basis of the check. The Supreme Court has to put an end to the case.
