THE ROSATOM AND T-PLUS STRUCTURES ARE REQUIRED TO PAY FOR THE USE OF SAP 16+
Lawsuits related to debts for using SAP software have begun in the Russian market. The creditor is the Legat company, which in 2024 bought the debt collection rights from the representative office of a German vendor in the Russian Federation. The amount of the assignment (the sum of the acquired claims) exceeded 2 billion rubles. The debt itself was purchased at a significant discount.

Atomenergoprom (JSC), a member of Rosatom, became one of the defendants in court. The corresponding claim of Legate for 571.2 million rubles was submitted to the court back in May (case no. A40-107142/2025). The lawsuit is related to SAP software products that were used until mid-2022. As noted in the materials, the plaintiff wants to receive compensation not only for the principal debt, but also for interest accrual during use.

At the same time, another lawsuit is being considered in arbitration. The defendant is the T-Plus energy company, which is required to pay 74.3 million rubles. The process has been going on since spring. Interestingly, SAP CIS appears as a third party in each of the cases. In the past, it was this company that represented SAP's interests in the Russian Federation.

Legat has been operating in Russia for the last 9 years and specializes in financial services. According to the results of its work last year, the organization reached 142 million rubles in profit.

Atomenergoprom, established 18 years ago, is a key part of the nuclear industry. The company provides a full cycle of work, starting from the uranium mining process and ending with the construction of nuclear power plants. Its revenue last year exceeded 5.6 billion.

Market participants note that many enterprises continue to use SAP products, despite the departure of a western supplier. According to experts, only about 15% of solutions have been replaced, and the process is slow due to the lack of domestic alternatives. Moreover, the need to support foreign systems remains high, which extends their service life by years.

Experts believe that Legat has every chance of achieving a positive decision through arbitration. However, it is not clear how well the assignment of rights was executed. At the same time, experts call the fact of selling debts at a large discount natural: a foreign supplier, leaving the country, wants to dump assets as quickly as possible and is not interested in lengthy proceedings in Russian courts.

Lawyers believe that similar cases will continue to arise, but they will not be accepted on a mass scale. After all, the statute of limitations on them is coming to an end. Thus, the practice of debt collection for the use of foreign software will remain spot-based and is unlikely to become a defining trend.
