THE RIGHT OF CLAIM OF "WEST SIBERIAN EXPANDED CLAY" IN 1 BILLION IS PUT UP FOR AUCTION
A large amount of debt (more than 1 billion rubles) to West Siberian Expanded Clay (LLC ZSK) has been put up for public auction. The auction will be held as part of the bankruptcy procedure that the company is undergoing. The debt is based on the company's claim against businessman Ravil Lezgiev. It is planned to be implemented through the ACOSTA platform. The organizer of this process is Oleg Kirillov, the bankruptcy trustee of the enterprise.

Earlier, the Tyumen Court (AS TO) confirmed the validity of these financial claims. The main part of the debt – over 1.014 billion rubles – was recognized in court in November 2023. A few months later, the court confirmed additional obligations in the amount of about 19.5 million rubles. 

The situation is related to the bankruptcy of KYC. The company received bankruptcy status two years ago at the request of the Federal Tax Service. The Tax Service initiated the process in connection with the overdue debt. The total amount of the company's debts approached 190 million rubles. Arrears were incurred due to non-payment of VAT and income tax. 

During the proceedings, the debtor's representatives actively filed petitions, trying to challenge the application of the Federal Tax Service and suspend the meetings due to procedural violations. But the arbitration court considered these grounds unworthy of attention, pointing out that the document from the tax authority was certified by an authorized person. 

The company also stated that it had the necessary assets, including finished products, to fully finance the court proceedings. However, the court found no evidence of active economic activity, and the submitted documents were considered insufficient. 

As a result, the claims of the tax authorities and the prosecutor's office were satisfied. The register of creditors' claims includes debts in the amount of almost 190 million. 

Ravil Lezgiev, whose debt to the company is now up for auction, previously became involved in a criminal history. The investigation found that for several years the entrepreneur had entered false information about transactions with one-day firms into the documents, which made it possible not to pay VAT. According to experts, the treasury suffered damage in excess of 285 million rubles. The materials of the criminal case against him were submitted to the court at the beginning of the year. For security purposes, the entrepreneur's assets (estimated at 27 million) were seized.
