The Arbitration Court of the Moscow District recognized the legality of the verdicts of lower courts that allowed Henrijs Vogels to be held vicariously liable. The former head of a large pharmacy chain 36.6, who was responsible for wholesale trade, was brought to justice by the capital arbitration in March 2023. The reason was his failure to fulfill the obligation provided for in article 9 of the insolvency Law.
According to the court, Vogels should have initiated the bankruptcy of the company "Farm-Logistics" no later than in June 2016. The firm headed by him could not repay its debt to creditors, which arose in March of the same year. However, there was no appeal "in the shortest possible time" with a lawsuit from Vogels.
In 2017, the company "Biting" came to the enterprise with the initiative of bankruptcy. In August, the arbitration took the company "Farm-Logistics" under surveillance. Another 1.3 billion was added to the existing claims of counterparties for 3.3 billion. In December 2018, the organization was declared insolvent with creditor claims of more than 7 billion.
Vogels, who worked at Oriola OY and Biotec, was appointed to a senior position in the pharmacy chain 36.6 in 2014. He took an active part in the process of integrating the pharmaceutical distributor Alliance Healthcare Russia (its operating company was Pharm-Logistics) into the structure of the pharmacy holding.
Sergey Shcherbinin and Andrey Shishkin were also candidates for the subsidiary in the bankruptcy case of Farm-Logistics. But the court did not find any legal grounds for bringing them to justice.
