THE RASPBERRY THEMIS ANTI-AWARD NAMED THE WORST LAWYERS OF THE YEAR

The legal community made a decision to nominate a number of the most "distinguished" representatives of the area for the "Raspberry Themis" anti-award. The award is given for high-profile failures to judges, lawyers and companies that made serious mistakes in their professional activities.

The anti-award includes 9 nominations, six of which have already found their winners by voting.

For example, the infamous Elena Khakhaleva was recognized as the judge of the year in the outgoing 2020. In July of this year, the Higher Qualification Board of Judges prematurely terminated her powers due to the numerous cases of unexcused absence. The servant of Themis was absent from the workplace for over 100 days without any excuse. Khakhaleva herself explained the situation by the fact that she was on business trips and sometimes was away for treatment.

A degree of lawyer of the year was awarded to the former lawyer Elman Pashayev for his work in protecting the famous actor Mikhail Efremov from criminal prosecution. Many believe that it was the wrongly chosen defense strategy that significantly influenced the severity of the sentence imposed on the actor. Among Pashayev's mistakes, there were not admitting guilt under obvious circumstances of guilt, and recusal of the judge, who, as a result, passed a verdict, as well as the involvement of dubious witnesses, who, as it turned out, were drunk themselves.

In addition, the defender did not help Efremov with the wording of the confession of guilt - in his last word, the actor said that he would admit it if he was guilty. This position was not interpreted as a confession, and did not affect the commutation of the sentence.

After the trial, by the decision of the Council of the Bar Association of the Republic of North Ossetia – Alania, Pashayev was deprived of his lawyer status for a period of 1 year.

The Deposit Insurance Agency was awarded in the Bankruptcy nomination for the insolvency procedure of Tagilbank and a number of other credit institutions. The claims of the legal community boiled down to excessive spending by the DIA as a manager in bankruptcy proceedings. In particular, in case of Tagilbank, bewilderment was caused by the exorbitant costs of cleaning and guarding the empty bank building, storing the exported property in the "golden" warehouse of Yekaterinburg, as well as payment for the services of the bar association, which refused to provide information about the work done.

Among other laureates, Roman Maslennikov was awarded in the Plaintiff nomination for his PR-claims against Alexander Lukashenko, Beltelecom, WHO and Microsoft MSN. Previously, he also filed claims against Yandex because of baldness and Ostankino because of dullness.
