THE OWNER OF THE MOSCOW CIRCUS WAS INVOLVED IN THE SUBSIDY
The arbitration court has placed the debts of the Aquamarine Dancing Fountain Circus in Moscow on its sole owner and head. The requirement to hold CEO Andrey Slesarev vicariously liable was satisfied in favor of the lender, Logopark Management.

The key reason for this decision was the inaction of the leadership. Back in April 2021, more than 2.74 million rubles of the principal debt and over 203 thousand penalties were collected from the circus, as well as additional penalties in case of delay. However, as the bailiffs found out, the company did not have any money or property to repay the foreclosure. 

The existence of such an unfulfilled decision, in the opinion of the arbitration, was a clear sign of insolvency, obliging the director to initiate bankruptcy proceedings. Instead, Slesarev did nothing, and the company's insolvency application was filed only by the creditor in August 2024. 

It is important to note that the bankruptcy case of the legal entity itself was not brought to an end. Production was discontinued at the end of 2024. The reason was the lack of money for legal costs and financing of the manager's work. This situation has become the legal basis for a separate lawsuit against the controlling person. Logopark Management took advantage of this opportunity as a plaintiff. 

The claim was considered without the participation of the defendant. Slesarev was duly notified, but did not send a review to the court and did not provide any evidence of his position. At the meeting, the creditor's claims were fully supported by his representative. 

The court found that the sole owner had been running the business alone since its inception in June 2019. This status uniquely defines him as a controlling person, which means he will be responsible for key decisions. An additional negative factor was information from the Unified State Register of Legal Entities about the unreliability of the company's legal address, which, according to the court, blocks normal communication and protection of creditors' rights. 

As a result, the full amount (2.74 million) of the principal debt, a penalty (203 thousand) and a fine (0.1% for each day of delay, starting from February 9, 2021) were collected from Slesarev in favor of Logopark Management. In addition, he was charged with the obligation to compensate for court costs, including the payment of a state fee of 114.3 thousand rubles.
