Timerbulat Bagautdinov, the former owner and director of the Amstron Kirzavod, managed to get the court decision overturned. According to it, he was charged with the obligation to cover the company's debt of 34.3 million. Fanil Mukhamadiev, who had previously been approved for the role of bankruptcy trustee, tried to involve him in the subsidiary for the debts of the organization. But the court of appeal found no reason to consider his actions the cause of the bankruptcy of the company.

The Bashkir Arbitration Court (AS RB) satisfied Mukhamadiev's claim two years ago. He claimed that since January 2019, Bagautdinov had been informed about the economic problems of the plant, but had been inactive. According to KU, instead of filing an application for insolvency and dealing with accounts receivable, the head continued unprofitable activities, thereby increasing the company's obligations. However, the court of appeal found these arguments insufficient.
 
The plant received the status of an insolvent enterprise at the end of 2021. The reason was the statement of the creditor, the Onyx company, to which the company owed about 3 million. The total amount of liabilities, according to the calculations of the manager, amounted to 34.3 million. It was this amount that he demanded to recover from the former director.
 
In the appeal, the ex-head said that at the time of the alleged occurrence of signs of bankruptcy, the assets of the plant exceeded its obligations, which means that there was no reason to file an application for insolvency. The court agreed with this argument, pointing out that in 2018 the company conducted real business activities, and a sharp deterioration in its situation occurred only in 2020 against the background of the COVID-19 pandemic and the bankruptcy of the lessor of the production facilities, Megastroyservice.
 
The brick factory was established in the fall of 2018. The company produced porous bricks. From the very first moment of his activity until 2024, the owner of Amstron was Timerbulat, the son of Rashit Bagautdinov, a well-known entrepreneur in the region.
 
According to a number of lawyers, the installation of the KU is based on a formal study of accounting, without trying to analyze specific contracts or examine the issue of damage to creditors. Experts believe that the likelihood of a review of the verdict adopted in the appeal is extremely low. Meanwhile, Fail Mukhamadiev does not rule out that he will file a cassation appeal after waiting for the publication of the full text of the court decision.
