The Arbitration Court of St. Petersburg and the region returned to the tax authorities their application for the insolvency of LLC Lemurrr-BB. The company, created as a tandem of the Vkusville chain and the Le'murrr zoo brand, temporarily avoided the procedure.

MI FTS No. 4 from Bashkortostan decided to go to court. However, the fiscal authorities themselves pointed out the lack of money in the budget to finance future bankruptcy. In addition, the agency stated that the company's assets were clearly insufficient to cover the standard costs of bankruptcy proceedings.

After examining the case, the judge referred to the letter of the law: the authorized body is obliged to prove the high probability of finding any funds from the debtor. Statements about real estate or transportation, property search reports, as well as prospects for challenging past transactions or involving directors in a subsidiary would be suitable as such evidence. But the package of documents from the tax authorities did not contain any of the above.

Moreover, the inspectors themselves de facto recognized the poverty of the debtor. Therefore, the arbitration court issued a ruling on the return of the application without motion. An important caveat: this does not prohibit the Federal Tax Service from filing a separate claim for subsidiary liability of the Lemurrr-BB management later, if legitimate reasons arise. Since the documents were sent through My Arbitrator, there was no physical sending of the papers – the court simply issued a verdict on the return.

Lemurrr-BB company was born as a bold pilot project of Ivanko Group and VkusVill retailer. Earlier, according to Alexey Ivashchenkov, it was reported that the partners intended to open a 50-square-meter pet store in the center of the Russian capital. If successful, they wanted to replicate the franchise. How much money was invested remained a mystery.

The money storm has also overtaken the businessman's related assets. Through the efforts of Alfa-Bank, Ivashchenkov was declared insolvent, sending him to the sale of assets. Back in 2020, the lender opened a 150 million line for the controlled Ivanko company. When there was a hitch with the debt repayment, the credit institution requested almost 100 million ahead of schedule and launched the bankruptcy of the borrower along with the guarantors.

Today, the Ivanko company is in the process of insolvency. Other creditors were added to Alfa-Bank (for example, about 25 million were asked by PSKB). The lawsuits are ongoing, and a series of hearings is already scheduled for the coming months.
