THE EX-HEAD OF THE MUNICIPALITY RECEIVED A FINE FOR THE BANKRUPTCY OF THE MUNICIPAL UNITARY ENTERPRISE
The court in the Kurgan region sentenced the former head of the Pritobolny district Sergey Spirin to a fine in the amount of 700 thousand rubles. The ex-head was banned from getting a job in local or state government bodies for two years. The basis was a criminal case of intentional bankruptcy. In addition, the court recognized the fact of abuse of authority (part 3 of Article 286).


The verdict itself has not yet entered into force and can be appealed. The punishment under two articles of the Criminal Code of the Russian Federation suggested that the ex-head could get a real 10-year sentence. However, apparently, the former head of the municipality has so far managed to avoid severe punishment.

Earlier, the Ministry of Internal Affairs of the Kurgan region reported that Spirin bankrupted the Municipal Unitary Enterprise "Pritobolye". The production assets of the company providing heat supply services were transferred to Energoservice. According to local media, Boiler houses together with equipment, as well as sections of heating mains with a total cost of over 23 million rubles, were transferred to a direct competitor.

The regional department of the Federal Antimonopoly Service intervened in the situation. The department considered that the district administration violated the legislation on protection of competition. At the same time, the FAS demanded that the municipal property be returned to the CBM. But by this time, delays in the payment of rent by a private company led to the fact that the municipal enterprise went into bankruptcy.

A commission was sent to the district to prevent an emergency situation related to the heating season. In the fall of 2017, it became clear that there were not enough funds in the budget of the Municipal Unitary Enterprise for this. The organization did not stock up on solid fuel, the state of deterioration of heating networks required urgent repairs, and the organization's debts to creditors exceeded 8 million rubles. An emergency regime was introduced on the territory of the municipality.

It turned out that the Municipal Unitary Enterprise did not pay off the supplier of coal, which made the delivery in March 2017. The amount of debt amounted to 2.8 million. Under the assignment agreement, the debt was transferred to the Energoservice company, which demanded to recover this amount from the defendant. In October 2018, the bankruptcy claim of the Municipal Unitary Enterprise was sent to arbitration (case no. A34-10679/2018).

The bankruptcy procedure of the CBM was completed in November 2022. In the process of bankruptcy proceedings, it was possible to sell the assets of the organization for 1.1 million rubles. The account received money in the amount of 5.1 million. All employees of the organization (13 employees) were fired, and the Municipal Unitary Enterprise was liquidated.
