THE EX-DIRECTOR OF NORDSTROI WAS INVOLVED IN THE SUBSIDY
The Arbitration Court of St. Petersburg and the Leningrad Region has decided to hold Konstantin Chechetkin, the former head of Nordstroy LLC, vicariously liable. This means that the debts of the bankrupt company will be repaid at the expense of his personal property. The final amount of the penalty will be determined later.

The company's insolvency process was launched three years ago at the request of the creditor. After the introduction of supervision and the subsequent recognition of the company as bankrupt in the fall of 2024, Igor Baranenko was approved as the bankruptcy trustee. It was he who, together with the creditor of Polytechnic LLC, initiated a motion to hold the ex-director accountable. The recovery requirements amounted to about 16.7 million rubles, while the manager insisted on full subsidiary liability. The court considered both applications in a single proceeding.
 
The most important factor for the decision was Chechetkin's role as the sole participant in the society. The court found that during the period of the onset of signs of insolvency, he continued to manage the company alone. At the same time, they did not fulfill the obligations to transfer the full set of documentation to the bankruptcy trustee, which significantly hampered the work with assets. Despite court orders and repeated requests, accounting documents, seals and tangible assets have not been provided in full.
 
The materials submitted later turned out to be incomplete. For example, the register of accounts receivable did not contain sufficient data to identify the majority of debtors, which made it impossible to collect these amounts. Serious problems also arose with stocks: according to the official accounting at the end of 2022, the company had more than 237 million in raw materials and supplies. But in fact, these values were not passed on to them.
 
According to information from the traffic police, in the past, Nordstroi had 8 vehicles on its balance sheet, which were subsequently reissued to other persons. The lack of primary documents on the transactions did not allow us to challenge some of them. But for those machines where the documentation base was restored, the court received over 20 lawsuits in order to invalidate the transactions.
 
Complicating matters was the fact that some of the data was seized in connection with a criminal case. We are talking about tax crimes in another organization. The court stressed that the storage of primary documents is the direct responsibility of the head. There was no evidence of the loss of documentation for reasons beyond Chechetkin's control.
 
The arbitration court drew attention to the late filing of an insolvency claim, the signs of which appeared at the end of 2020. The head was obliged to go to court at the beginning of 2021. Instead, the company continued to conduct business activities, formalize new transactions and increase debts, which later turned out to be irrecoverable. Based on the totality of these violations, the court held Konstantin Chechetkin vicariously liable.
