THE DEBTORS’ MINIMUM SUBSISTENCE WAGE WILL BE SPECIFIED

The draft law providing for a need to leave a certain amount of money to debtors for the fulfillment of their minimum needs will be considered shortly. 




In accordance with the document, it is proposed to determine the amount of money that should be left to the debtor when writing off the debts by his creditors. Earlier it was proposed that this amount would be equal to the minimum wage or the value of the subsistence minimum. However, the situation is complicated by the fact that the different values are set in different regions, on the basis of which it is planned to calculate the maximum amount which can be written off of the debtor's funds. 

In addition, a situation when a person is registered in one entity, but works and actually lives in another may arise as well, in connection with which there is a risk of legal uncertainty. 

To eliminate it, the deputies proposed to specify what value (federal or regional) should be taken as a basis when calculating the maximum possible write-offs of the debts by creditors.

A draft law introducing a mandatory minimum amount that is left to a debtor after creditors have written off the debts is to be considered by the lower house of parliament by this fall.
