THE COURT WILL CONTINUE TO CONSIDER THE BANKRUPTCY CASE OF THE EX-CO-OWNER OF ECOPROMBANK
The Rostov Arbitration Court (AS RO) refused to satisfy the petition of the tax authority, which asked to terminate the insolvency proceedings of the ex-co-owner of Ecoprombank Vladimir Nelyubin. Despite the statement of the Federal Tax Service to withdraw from the process, the proceedings will continue on the initiative of another creditor.

The Regional Inspectorate No. 24 of the Federal Tax Service for the Rostov Region had previously sent a document to the court in which it refused to finance the insolvency procedure. But at the same time, the arbitration received a claim from Mikhail Potapov's sole proprietor. In it, the businessman asked to recognize the insolvency of Nelyubin. 

At the end of May, AS RO accepted the appeal, considering the presence of a new creditor to be sufficient reason not to consider the application of the fiscal service. Now the key initiator of the process is entrepreneur Potapov. The hearing, at which the court will verify the validity of his claims, is scheduled to be held on November 11. 

It is worth noting that this is not the first bankruptcy procedure for Nelyubin. For the first time, the insolvency proceedings began nine years ago. Then the amount of his debts to creditors listed in the register exceeded 2.84 billion rubles. This procedure was completed last spring. But this did not release the ex-co-owner of the bank from obligations in excess of 31 million to the Federal Tax Service. 

The history of bankruptcy is closely related to the criminal aspect of the case. Six years ago, the district court found the banker guilty of embezzling Ecoprombank funds in excess of 215 million. He was sentenced to 6 years and 3 months in prison. He was released on parole in the spring of 2024. 

Despite the procedure completed earlier and the sentence served, now the former co-owner of Ecoprombank has once again found himself at the center of the bankruptcy process. This time, the fate of his financial obligations will be decided by arbitration at the request of a new creditor.
