THE COURT TERMINATED THE BANKRUPTCY OF THE CRIMINAL CODE "CONSTRUCTION OF MINES" DUE TO LACK OF FUNDS
The Tax Service initiated the insolvency process, but the court did not find the financial opportunity to continue it. The Arbitration Court of the Novosibirsk Region (AS NSO) issued a ruling on the termination of bankruptcy proceedings against the Mine Construction management company. The claims were based on the debt to the budget, which exceeded 168 million rubles last fall.
The financial analysis showed that there were no sources to cover the costs. The case file states that the debtor has no registered real estate. The only listed piece of equipment is leased, meaning it cannot be sold to pay off expenses. According to the Federal Tax Service, the company's three open settlement accounts do not have the liquidity to conduct the procedure.
In January of this year, the debtor's management independently appealed to the court with a request to stop the proceedings. However, the key argument for the verdict was the court's position on the economic inexpediency of further actions. The tax authority separately notified the court that it was not possible to allocate budget funds to cover the costs of the case.
The judge took into account that the applicant (Federal Tax Service No. 7) was unable to provide data on assets sufficient to finance at least the minimum costs of bankruptcy proceedings. There are also no statements from other creditors about their intention to assume these obligations in the case. The combination of these factors led to the conclusion that the procedure was obviously unprofitable.
The ruling comes into legal force immediately, while the parties have the right to file an appeal within thirty days. Experts attribute the situation to typical risks in the mining industry's service sector.
According to information from open databases, the company is registered in Novosibirsk. The size of the authorized capital is 10 thousand. The only founder is Andrey Lesnikov. At the end of the fourth quarter of last year, the company's tax debt increased to 171.8 million rubles, which confirms the existence of unresolved financial difficulties.
