The litigation related to the right of indefinite use of a piece of territory in the center of Sochi continues. The cassation court decided to return the case for review. The question of the legality of disposing of a plot of land owned by the Russian Federation arose after the Rusichi company received part of the territory of the Cooperative Park in the 1990s. A cafe and a shop were built on the ground. But currently, the mayor's office and the prosecutor's office are challenging the legality of this deal in order to return the site to the city.

Earlier, the arbitration courts recognized that Rusichi LLC does not have the right to use the land indefinitely. But the Court of Cassation overturned these decisions. The case has now been returned to the Kuban Arbitration Court (AC CC) for a new review. 

In the center of the proceedings is a land plot of over 1.5 hectares. Its cadastral value is about 439.8 million. The building (502.7 sq. m.), where the cafe and shop are located, has an official registration and is owned by two entrepreneurs and the Rusichi company. Since 2021, the building has been leased by the company "Pancakes of the South". 

The area of the disputed plot (900 sq.m.) has now been fenced. Representatives of the "Pancakes of the South" claim that the rental relationship concerns not only the premises, but also the territory adjacent to the building. 

The Rusichi company, which was founded in 1997, is currently in the process of bankruptcy. There are 9 enforcement proceedings against the organization. The total amount of the collection is over 16 million rubles. Recent financial statements have had zero results. 

The Rusichi received the right to use the land plot more than a quarter of a century ago. In 1997, a corresponding decree was adopted by Sochi officials. But the prosecutor's office disputes this fact, pointing out that by that time the organization as a legal entity had not yet existed. In addition, the municipality could not dispose of land belonging to the federal resort area. 

The current Sochi administration is challenging this right in court. Officials claim that it was obtained illegally. The regional arbitration Court is currently considering the claim of the mayor's office for the demolition of the building, since it was built without permission. But the process was suspended until the completion of the construction expertise, which, according to experts, influenced the conclusions of the Court of Cassation. 

The "Pancakes of the South" partially won in cassation, having achieved the restoration of their participation in the process. The main problem for the city administration remains the question of the legality of the initial land grant. It is likely that the land was transferred in circumvention of prohibitions on the disposal of resort lands, which may significantly affect the final court decision.
