THE COURT RECOVERED MORE THAN 255 MILLION FROM THE BANKRUPT CONTRACTOR FOR DELAYING CONSTRUCTION
The appeal (the 7th Arbitration Court of Appeal) confirmed the legality of the lower court's decision to forcibly recover more than 255 million from the contractor company for failing to meet the deadline for the construction of a social facility. After reviewing the complaint from Likstroy, the court found no grounds to overturn the verdict of the Novosibirsk Arbitration Court, leaving the debt amount in place. The appeal deemed the construction company's arguments unconvincing, resulting in the court's decision remaining unchanged.

The key subject of the dispute was the non-fulfillment of obligations under the state contract. The deal was finalized in the spring of 2023. According to the agreement, it was planned to build a 400-bed school in the village of Suzun (Novosibirsk region). The initial price of the agreement was almost 573 million rubles. The facility was supposed to be completed by the end of 2024. Since the contractor did not meet the agreed deadline, the customer (UKC) appealed to the court with a demand to return the listed advance as unjustified enrichment. The claim was fully satisfied.

During the proceedings, representatives of Likstroy tried to challenge the methodology for calculating the amount to be recovered. The company's defense argued that the final amount should be reduced based on the actual costs incurred. As proof of their expenses, the company cited the construction of a pile foundation, the installation of a 76-meter-long section of a heating system, and the purchase of materials used in the construction process. However, the court of appeal rejected these arguments.

Back in October 2024, the contract between the municipal customer and the contractor was officially terminated, and the organization was obliged to return 255.9 million. Subsequently, the company's financial situation deteriorated rapidly, and in January 2026, Liksstroy LLC was officially declared insolvent. The bankruptcy proceedings were initiated by Ares Group, which filed claims worth approximately 6 million.

 Following the termination of the contract with the unscrupulous contractor, the district authorities intensified their efforts to find a new contractor to complete the construction project. In November last year, the Capital Construction Department announced a tender with an initial price of 1.49 billion. According to the terms of the new procurement procedure, all construction and installation works on the educational facility must be completed by March 31, 2027.
