THE COURT CANCELLED THE SEIZURE OF BILLIONS OF ASSETS OF THE EX-HEAD OF OTKRITIE HOLDING
The Arbitration Court of the capital has decided to lift the security restrictions on the property of Alexey Karakhan, who previously served as Chairman of the Management Board at Otkritie Holding. The reason for the cancellation was the completion of a key dispute in the company's bankruptcy case. The total value of the previously seized assets was estimated at 916.2 billion rubles.

The history of the issue originates in lawsuits initiated by bankruptcy trustee Maria Bulatova. She insisted on involving eighteen individuals in the subsidy, whose actions, according to the applicant, led to the formation of enormous debts. The total amount of liabilities of the financial structure is approaching the level of 1 trillion rubles.

Initially, two years ago, the arbitration court supported the manager's petition. At that time, the property of a whole group of ex-beneficiaries and former top managers was seized. The list of defendants included the founder of the company Belyaev, ex-president of the bank Aganbegyan, ex-CEO Shkodinsky, Konyaev and Fedoseev. The restrictions also affected Karakhan. Later, the security measures were extended to Aganbegyan's wife, Veronika Misyutina.

The key circumstance for the review of the case against Karakhan was the court's act, which entered into force. He confirmed that the former chairman of the board should not be responsible for the debts of the organization. The arbitration found that the effect of the arrest was in conflict with a fair balance of interests. The measures themselves have lost their relevance and become redundant. The main requirement for it was rejected, which automatically removed the grounds for withholding restrictions. 

The bankruptcy proceedings of Otkritie Holding are continuing with respect to other defendants. To date, the cassation has already approved a subsidy for Vadim Belyaev, Ruben Aganbegyan and Dmitry Romaev (ex-chairman of the bank's management board). As for the other defendants, their cases have been sent for reconsideration. The judges will have to re-analyze the degree of influence of these individuals on the emergence of financial problems of the company.
